By placing an order with KENDIRA, you agree to be legally bound by these Terms.

4. Orders
4.1 Order Acceptance
All orders are subject to confirmation and product availability.
4.2 Customer Responsibility
You are responsible for providing accurate and complete information, including delivery address, contact details, and dietary requirements.
4.3 Order Refusal
KENDIRA reserves the right to refuse or cancel any order due to:

Product unavailability

Operational limitations
-
Payment issues
-
Suspected fraudulent activity
5. Pricing & Payment

All prices are in Hong Kong Dollars (HKD)

Prices include applicable taxes unless stated otherwise

Delivery fees and service charges may apply

Online payment platforms
Full payment is required at the time of order for delivery orders.
6. Delivery Policy
6.1 Delivery Time
Delivery times are estimates only and may vary depending on traffic, demand, or external conditions.
6.2 Delivery Area
Delivery is available within selected areas of Hong Kong.
6.3 Failed Delivery
If delivery cannot be completed due to incorrect information or customer unavailability:

The order will be considered fulfilled

No refund will be issued
6.4 Risk Transfer
Ownership and responsibility for the order transfer to the customer upon delivery.
7. Severe Weather Policy
In the event that a Typhoon Signal No. 8 or above or a Black Rainstorm Warning is issued by the Hong Kong Observatory:

All delivery services will be automatically suspended
-
No deliveries will be performed during this period
Affected orders will be:
-
Rescheduled to the next available time slot, or
-
Converted into store credit, upon request
KENDIRA shall not be held liable for delays or service interruptions caused by such events.
8. Catering Services
8.1 Booking & Lead Time
Catering orders must be placed at least [48–72 hours] in advance, depending on order size.
8.2 Payment Terms

A non-refundable deposit of 50% is required upon confirmation
-
The remaining balance must be paid in full at least [24–48 hours] before delivery or event
No catering order will be prepared or delivered without full payment.
8.3 Minimum Order
A minimum order amount of [HKD X,XXX] may apply.
8.4 Changes
Any modification must be requested at least 48 hours in advance and is subject to availability.
9. Catering Cancellation Policy

Cancellation more than 72 hours before the event:
→ Deposit is non-refundable but may be converted into credit valid for [30–60 days] -
Cancellation less than 72 hours before the event:
→ 100% of the total order amount is non-refundable
10. Cancellation & Refunds (Delivery Orders)
Orders cannot be canceled once preparation has started.
Refunds may be issued at KENDIRA’s discretion in the following cases:

Incorrect items delivered

Missing items
-
Verified quality issues
Claims must be submitted within 24 hours with supporting evidence.
11. Food Safety & Allergies
KENDIRA complies with applicable food safety regulations in Hong Kong.
However:

We cannot guarantee that food is free from allergens (including nuts, gluten, dairy, etc.)

Customers must inform us of any allergies prior to ordering
KENDIRA shall not be liable for allergic reactions.
12. Late Payment / Non-Payment
KENDIRA reserves the right to:

Suspend or cancel any order
-
Retain any deposit paid
-
Refuse future orders
In case of failure to pay the outstanding balance within the required timeframe.
13. Force Majeure
KENDIRA shall not be liable for failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to:

Severe weather conditions
-
Transportation disruptions
-
Government restrictions
14. Third-Party Platforms
If orders are placed via third-party platforms (e.g., Foodpanda, Deliveroo, Keeta):

Their respective terms & conditions shall also apply

In case of conflict, the platform’s terms may prevail
15. Intellectual Property
All content on the KENDIRA website, including branding, logo, text, and images, is the exclusive property of KENDIRA and may not be used without prior written consent.
16. Limitation of Liability
To the maximum extent permitted under Hong Kong law, KENDIRA shall not be liable for:

Indirect or consequential losses

Delivery delays
-
Loss arising from misuse of the website or services
17. Privacy
Personal data is collected and processed in accordance with applicable data protection laws in Hong Kong.

18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR.
Any disputes shall be subject to the exclusive jurisdiction of the Hong Kong courts.

KENDIRA reserves the right to update these Terms at any time. Continued use of the website and services constitutes acceptance of the revised Terms.
